Terms of sale
Effective from: 2026-10-14
§ 1. Seller and contact
- The seller is CodeTheWeb, running a business under the name CodeTheWeb, address: ul. Przykładowa 1, 00-000 Miasto, Polska, Polish tax ID (NIP): 9491562544, REGON: 000000000, registered in the Polish Central Register and Information on Economic Activity (the “Seller”).
- You can contact the Seller through the contact form on codetheweb.dev or by e-mail: kontakt@codetheweb.pl.
- These Terms set out the rules for selling licences for PrestaShop modules through codetheweb.dev (the “Website”) and for using the electronic services provided on the Website.
§ 2. Definitions
- Customer — a natural person, legal person or organisational unit placing an order on the Website.
- Consumer — a Customer who is a natural person concluding a contract not directly related to their business or profession.
- Sole trader with consumer rights — a natural person running a sole proprietorship who concludes a contract directly related to that business, where the contract shows that it is not of a professional nature for them, in particular in view of the business activity disclosed in the Polish business register (CEIDG).
- Module — software (digital content) that extends the functions of a PrestaShop store, described on the page of that module.
- Licence — the right to use the Module on the terms set out in § 4.
- Domain — the store address the Customer specifies when ordering.
§ 3. Technical requirements
- To place an order you need a device with internet access, an up-to-date web browser with JavaScript and the cookies required for payment enabled, and an active e-mail address.
- To use the Module you need a PrestaShop store in the version, and a server with the PHP version, stated on the module page under “Compatibility and terms”.
- A Module may require additional external services described on its page (for example an API key from an artificial-intelligence provider). The Customer pays for such services directly to their provider.
§ 4. Licence
- Upon payment of the price, the Seller grants the Customer a non-exclusive, non-transferable licence to use the Module in one online store operating under the Domain, without time or territorial limits.
- The Licence covers installing the Module in the store under the Domain and in its test and development copies that are not publicly available to shoppers.
- The Customer may modify the Module’s code for their own needs. The Customer may not resell, share, sublicense or distribute the Module or its modified versions to third parties.
- The period of technical support and access to updates is stated on the module page. After it ends the Module keeps working; extending support or updates may be subject to a fee.
- The Customer may change the Domain twice a year in the “My licenses” panel; further changes require contacting the Seller. The Module works without an additional Licence on test stores (e.g. localhost, *.local and *.test addresses, dev. and staging. subdomains of the Domain).
- The Module verifies the Licence locally, using the signed licence file included in the package or the licence code available in “My licenses”. The Module does not connect to the Seller’s server for this purpose and does not send it any data. A missing valid Licence does not block the Module from working in the store — it only means no access to updates and support.
§ 5. Prices
- Prices on module pages are net prices and do not include VAT.
- VAT is added in the payment form at the rate applicable to the Customer, determined by the country in the address and the Customer’s status. Businesses from other European Union countries that provide a valid EU VAT number account for VAT under the reverse-charge mechanism.
- The total price payable, including VAT, is shown in the payment form before the order is placed.
- Prices are given in Polish zloty (PLN) or euro (EUR). The Customer chooses the currency on the module page.
§ 6. Ordering and conclusion of the contract
- To place an order, the Customer ticks the consent referred to in § 9(3) on the module page, selects “Buy now” and then, in the payment form, enters their e-mail address, invoice details (including, where applicable, a Polish NIP or EU VAT number) and the Domain, and accepts these Terms.
- The order is placed by clicking the payment button in the payment form, which constitutes an order with an obligation to pay.
- The contract for the Licence is concluded when the Seller receives confirmation of payment. The Seller sends confirmation of the contract, including the consent referred to in § 9(3), to the Customer’s e-mail address.
§ 7. Payments
- Payments are processed by Stripe Payments Europe, Ltd., Ireland. The available payment methods are shown in the payment form (for example payment card, BLIK, Przelewy24, Apple Pay, Google Pay).
- Payment is due in advance. The Seller does not store payment card details.
§ 8. Delivery of the Module
- After payment is confirmed, the Seller sends the Licence key and a link to download the Module (ZIP file), valid for 7 days, to the Customer’s e-mail address — usually within minutes and no later than within 1 business day. The Module is deemed supplied when this message is sent.
- The Customer can download the latest version of the Module at any time in the “My licenses” panel on the Website, signing in with a link sent to the e-mail address used for the purchase.
- If the Customer has not received the message within that time, they should check their spam folder and contact the Seller.
§ 9. Right of withdrawal
- A Consumer and a Sole trader with consumer rights may withdraw from the contract within 14 days of its conclusion without giving any reason, subject to paragraph 3.
- To withdraw, it is enough to send the Seller a statement, for example by e-mail to kontakt@codetheweb.pl or through the contact form. The model withdrawal form at the end of these Terms may be used but is not mandatory.
- The right of withdrawal does not apply if the Seller has supplied the Module (digital content) with the Customer’s express prior consent, given before the end of the withdrawal period after being informed that they would thereby lose the right of withdrawal, and has provided the Customer with confirmation of that consent. The Customer gives this consent by ticking a separate box, not pre-ticked, on the module page before proceeding to payment. Without this consent a purchase through the Website is not possible; a Customer who does not wish to give it may order through the contact form.
- Until the Module is delivered, the Customer may withdraw from the contract under paragraphs 1 and 2.
- If the withdrawal is effective, the Seller refunds all payments without undue delay and no later than within 14 days, using the same payment method the Customer used, unless the Customer agrees to another.
§ 10. Conformity of the Module with the contract and complaints
- The Seller is liable to a Consumer and a Sole trader with consumer rights for any lack of conformity of the Module with the contract that existed at the time of delivery and became apparent within 2 years of that time, under the Polish Consumer Rights Act. The Customer may require the Module to be brought into conformity and, in the cases provided for by law, a price reduction or withdrawal from the contract.
- Complaints can be submitted by e-mail to kontakt@codetheweb.pl or through the contact form. Please describe the problem, the PrestaShop and PHP versions and the Domain.
- The Seller responds to a complaint within 14 days of receiving it.
- For Customers who are neither Consumers nor Sole traders with consumer rights, the Seller’s statutory warranty liability is excluded and the Seller’s total liability is limited to the price paid for the Licence, except for damage caused intentionally. The Seller is not liable to such Customers for lost profits.
- The Seller recommends backing up the store before installing or updating a Module.
§ 11. Electronic services
- On the Website, the Seller provides a contact form free of charge. The contract for this service is concluded when the form is sent and expires once a reply has been given.
- Sending unlawful content through the Website is prohibited.
- Complaints about electronic services can be submitted as described in § 10(2). The Seller handles them within 14 days.
§ 12. Invoices
- The Seller issues a VAT invoice to the details entered in the payment form, in accordance with applicable law, and sends it to the Customer electronically. The Customer accepts receiving invoices electronically.
§ 13. Personal data
- The processing of personal data is described in the Privacy policy available on the Website.
§ 14. Out-of-court dispute resolution
- A Consumer may use out-of-court complaint and redress procedures. Consumers in Poland may contact a municipal or district consumer ombudsman or the Trade Inspection; consumers in other EU countries may contact their national consumer body or the European Consumer Centre in their country.
§ 15. Final provisions
- Contracts concluded through the Website are governed by Polish law. This choice of law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
- The Seller may amend these Terms for important reasons, in particular changes in the law or in the scope of services. Contracts concluded before an amendment are governed by the Terms in force at the time of conclusion.
- Matters not covered by these Terms are governed by the Polish Civil Code, the Consumer Rights Act and the Act on the Provision of Electronic Services.
